Bill Cosby's attorney says he is anxious about entertainer's health

The comedian was facing three charges of aggravated indecent assault.

Cosby was charged with drugging and sexually assaulting Andrea Constand, the former director of operations for Temple University's women's basketball team, at his home near Philadelphia in January 2004.

The Bill Cosby jury in his rape case may have been hopelessly deadlocked, leading to a mistrial, but social media have a shorter word for the comedian's wife: hopeless.

Cosby, who gave the deposition as part of Constand's lawsuit against him, said he got seven prescriptions for the powerful sedative in the 1970s for the goal of giving them to women with whom he wanted to have sex.

He remained stoic as the judge declared a mistrial, but his spokesman Andrew Wyatt declared the star's "power is back".

He co-starred in the 1960s espionage show "I Spy", the first black performer to star in a weekly American TV dramatic series.

The judge sought to comfort the jurors, at least one of whom fought back tears, calling their epic deliberation "one of the more courageous acts, one of the more selfless acts that I've seen in the justice system".

Approximately 60 accusations of sexual assault have been made against Cosby over a number of years, but only Constand's resulted in criminal charges because the other alleged incidents were too old to prosecute.

The jurors clearly struggled with their verdict, telling Judge Steven O'Neill on Thursday they were at impasse. "We commend those prosecutors who raised awareness that one of the hallmarks of drug-related sexual assaults is the effect the drug has on the victim's memory and ability to recall and were nonetheless willing to present this evidence to the jury". O'Neill instructed them to keep working toward a unanimous decision.

Cosby said in that decade-old testimony that he had given Constand a non-prescription allergy medication, Benadryl, to relax her because she said she was stressed.

The defense has said Cosby and Constand were lovers sharing a consensual moment of intimacy.

Seven women are suing Cosby for defamation in separate lawsuits pending in MA, where Cosby has a home in Shelburne Falls.

Dozens of women have come forward to say he had drugged and assaulted them.

But the comedian was positive, McMonagle said.

"We will evaluate and review our case".

"Courageous", Steele told me is the word he uses to describe her.

Before going on trial, Cosby expressed hope he could eventually resume his career.

His depositions in that case, however, were unsealed by a federal judge in 2015, revealing his admissions that he had given sedatives to young women in the 1970s and prompting prosecutors to reopen the case.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
